Fresh evidence refused for lack of sufficient explanation under s83V(1); the trial judge was entitled to accept PW1's evidence because the identified inconsistencies were immaterial or explicable by fear, confusion or lapse of memory; D2's acquittal rested on mismatching descriptions and did not undermine the prosecution case against the applicant; individual sentences and overall total of three years were not excessive; accordingly the applications for leave to appeal against conviction and sentence were dismissed.
