Leave to appeal was refused because the fresh grounds were either without merit or not properly grounded in the pleaded case and trial record; specifically the claimed separate fiduciary duty and right to an account of funds in the 1st Third Party's personal account was not pleaded or pursued at trial, no amendment or rebuttal evidence was sought, and the District Judge was entitled to refuse relief. The new grounds did not justify overturning the Judge's decision and the application was totally without merit.
