The court accepted the contemporaneous documents and parties' conduct, rejected the defence that the agreement was a sham, held subsequent communications and payments were admissible and corroborative of a genuine contract, found breach of the Ho King Agreement and enforceable personal guarantees by Ho and YS Chan, and entered judgment for the plaintiff accordingly.
