Both registrations revoked. The 1st Design was revoked because its single 2D outline did not disclose the essential three-dimensional shape required to define the monopoly and in any event lacked novelty in light of publication and worldwide sale of the Plaintiff's PSM meter since the 1960s; the 2nd Design was revoked because the component parts are internal, their configuration is dictated solely by function, they have no eye appeal and also lacked novelty. Costs ordered nisi to the Plaintiff with directions for assessment if parties cannot agree.
