    FU CHAK MING v. 康泰旅行社有限公司

    Citation
    FU CHAK MING v. 康泰旅行社有限公司
    Court
    Court of First Instance
    Case number
    HCSA45/2004

Leave to appeal was granted because there were arguable issues as to (1) whether the tour contract was entire such that failure to supply a programme warrants full refund and (2) whether the Adjudicator's method of assessing damages (time apportionment and exclusion of certain costs) and refusal to award general damages for disappointment were correct; amendment to include the second claimant was permitted under Order 20 rule 8. Grounds of bias and alleged factual error on ticket cost were not allowed as grounds for leave.
