The Court of Appeal held that the intervener demonstrated a reasonably arguable procedural irregularity in that the judge gave substantive judgment on the originating summonses without giving the intervener an adequate opportunity to file evidence and make submissions, and that this made the appeals have real prospects coupled with potential prejudice to the intervener (given the trading businesses affected).
