Applying the Shanning standard the judge found defendant's cross-claims genuinely arguable only up to just under $3.3m but that the defendant had no genuinely arguable set-off in respect of the $3,157,581.73 recovered by Shun Cheong; accordingly an interim payment of $3,000,000 to the plaintiff was ordered and costs were ordered to follow the event (order nisi).
