The Tribunal held that a subdivision must be genuine and valid to be recognized under L.N.6 of 2010; a mere paper subdivision by registration without actual lawful physical subdivision (and which breaches the Deed of Mutual Covenant or Occupation Permit) is not a valid subdivision for the purposes of the Notice, therefore the units on the 3rd floor are to be treated as a single unit for threshold calculation and the Respondents' strike out summonses fail.
