The Defendant failed to prove any common intention constructive trust or other equitable interest; credible evidence established that the purchase shortfall came from the Plaintiff and SY, that SY and Plaintiff were the legal and beneficial owners, and that the Defendant occupied the Property as a licensee; accordingly the Plaintiff is entitled to possession, mesne profits, interest and costs.
