The judge held there was a fairly arguable defence that could be made by the defendants (notably by adducing oral evidence of a reservation of title and relying on the bills of lading), so unconditional leave to defend granted by the Master had to be qualified: leave to defend was to be granted only on conditions (payment of $100,000 into court within 21 days) and the defendants must provide security for costs of $200,000; further procedural and release orders were made to protect parties' interests.
