Singlets are goods of the same description as 'clothing except singlets and underwear' because their nature, use and trade channels are the same; the dominant '555' numeral in the applicant's composite mark produces the same overall impression as the registered '555' marks and creates a likelihood of confusion; a disclaimer of '555' does not cure the likelihood of confusion; accordingly registration in respect of clothing must be refused and the Registrar's decision is upheld.
