The gratuity paid to the plaintiff as a result of death ($9,114.60) is excluded under s.9(1) and must be disregarded; however the retirement gratuity that the deceased would have received had he lived to retirement ($33,130.60) constitutes a lost benefit to which the plaintiff is entitled a proportion of—court awards one third ($11,043.50) as compensatory loss—and this is to be included in assessing general damages together with assessed dependency ($450 pcm, multiplier 6).
