Though payments by Luu were shown to have the character of loans and there is evidence of repayments, the Trustees failed to discharge the burden to prove on the balance of probabilities any specific outstanding sum; the 2017 Decision does not create a binding issue estoppel on repayment quantification in these special circumstances; accordingly the Trustees’ proof is not admitted and the summons is dismissed.
