The application to exclude the respondent was dismissed because the alleged conflict of interest was more apparent than real: the respondent is the minor's natural grandmother with a closer caring relationship; the adverse property claims are brought by third parties not by the respondent; therefore there is little practical risk to the minor's interests and the best interest principle required refusal of the exclusion.
