The trial judge properly applied the Turnbull guidance and was entitled to accept the voice identification and corroborating circumstantial evidence that the three calls originated from the appellant's registered fixed line at his residence; no material procedural or evidential defect was shown and the appellant failed to establish that counsel's conduct was so deficient as to deny a fair trial; accordingly there was no miscarriage of justice and the conviction stands.
