Given the uncontradicted observations of prosecution witnesses that the appellant repeatedly picked up and assembled metal rods at a demarcated hawking pitch, supported by location photographs and in the absence of any defence evidence, the only irresistible inference was that the appellant had taken employment; the appellate rehearing was satisfied beyond reasonable doubt and the conviction stands.
