The magistrate's committal was upheld because Elliott's affidavit was duly authenticated and admissible under s.11(1)(b) as a document purporting to have been received in evidence in Canada; although portions of Wong's affidavit expressing retroactive opinion were arguably inadmissible, the remaining admissible evidence together with Elliott's affidavit was sufficient under s.7(4) to warrant trial and therefore mandatory committal; other objections (taped conversations, police interviews, cautioning, alleged bad faith, forum) did not negate the committal duty.
