Section 118F(1) of the Crimes Ordinance is discriminatory and inconsistent with the Basic Law and the Hong Kong Bill of Rights because it singles out male homosexuals for criminalisation of public buggery without any rational, proportionate or evidenced justification; accordingly the provision is invalid and the magistrate's dismissal of the charges was correct.
