The court accepted the contemporaneous identity verifications by plaintiff's staff and the bank, rejected the 2nd Defendant's account and handwriting expert evidence as unreliable, held the Loan Agreement and 2nd Legal Charge were valid and enforceable against the 2nd Defendant, and awarded the plaintiff the revised principal, unpaid instalments and contractual pre- and post-judgment interest at 24% p.a., dismissed the counterclaim and ordered vacant possession subject to conditions.
