Expenses qualify as election expenses only where they are closely related to the machinery of an election and incurred for the principal purpose of promoting a candidate; where promotional material produced earlier is made available during the election period the relevant accounted expense is the effective cost attributable to the election period (here the HKD 20,000 licence/upload fee), not the full production cost, and therefore no breach of s24 ECICO was established and the election was not vitiated.
