    The court found as fact that the defendant (through her husband) caused three substantial illegal additions which increased the roofed-over area beyond 700 sq.ft., thereby breaching the Crown Lease, Buildings Ordinance and Deed of Mutual Covenant; because the vendor could not pass a good title either on 5 October 1994 or on completion date, the purchaser was entitled to refuse completion and recover the $150,000 deposit; the vendor's counterclaim to forfeit the deposit failed.
