Because the defendant advanced an arguable case on illegality and execution of possession would likely render the appeal nugatory by irreversibly terminating the business, the Court exercised its discretion afresh and granted a conditional stay of execution: payment of a substantial sum to plaintiffs within 21 days and ongoing monthly payments into court pending determination of the appeal; costs to be in the cause and earlier cost orders by the single judges were not disturbed.
