Although the plaintiffs' delay was inordinate and inexcusable, the defendants failed to demonstrate that the delay caused serious prejudice or that a fair trial would be impossible; defendants' earlier conduct in 2012 of choosing to proceed and the availability of objective evidence and expert reports meant that striking out would be disproportionate. Therefore the strike-out applications were dismissed.
