The petition was dismissed because the debtor adduced sufficiently credible and particularized evidence raising bona fide disputes on substantial grounds as to (a) whether Junson Capital was a "money lender" under s2 MLO thereby engaging ss22 and 23 and rendering the loan agreements potentially unenforceable, and (b) whether the transactions were extortionate under s25 — issues requiring trial rather than summary bankruptcy procedure; the security point failed.
