On the balance of probabilities the Court found the Staircase illumination was insufficient and both defendants (as employer and occupiers) breached their duties by failing to provide a safe place and a safe system of work (including lack of instructions regarding the LED searchlight). The plaintiff was contributorily negligent to the extent of 20% for improper management of patrol equipment and LED usage.
