The court held that, to give effect to the prior order of 8 October 1998 requiring the company to purchase the petitioners' shares if the respondents failed to do so, the receivers must be expressly authorized to use the company's funds for that acquisition; accordingly the receivers were empowered to use company monies to acquire specified shares at a fixed price and within a fixed timeframe.
