The contract was a sale by description; the year of manufacture (1989) formed part of that description; the supplied machine was made in 1985 which was a material misdescription and thus a breach of the implied condition under s15(1) SGO; Artech dealt as a consumer and therefore CEO Cap.71 s11(2) prevented Yee Fat relying on Condition 7 to exclude liability; consequence: Artech entitled to rescind and recover the deposit and interest; counterclaim dismissed.
