The tenant validly surrendered the tenancy on 31 July 1985 by returning the keys and vacating and the landlord's subsequent conduct (cessation of rent collection, ruling off ledger and no further demands) objectively amounted to acceptance of that surrender by operation of law; the landlord had breached the implied obligation to supply proper air-conditioned air resulting in a minimum assessed loss of $250 per day, which extinguished the landlord's claim for rent and charges beyond the surrender date and entitled the tenant to recovery of her deposit.
