The Court held that the plaintiff's pleaded tort claim was in reality a contractual claim arising from her employment and therefore fell within the exclusive jurisdiction of the Labour Tribunal; the tort cause of action was 'window dressing'. The claim was an abuse of process for not being brought earlier, was barred by the clear waiver in the Settlement Letter (except for the medical claim expressly reserved), and, in any event, the claims were time‑barred. Accordingly the statement of claim was struck out and the action dismissed.
