The Court held the judge correctly applied a weight‑based starting point of 8 years for c.29.84g of methamphetamine and erred in enhancing that starting point by 1 year for importation; the appropriate enhancement for importation in this quantity band is 6 months, resulting in a substituted sentence of 5 years 8 months imprisonment.

Leave to appeal out of time was refused because the applicant's 26‑month delay was substantial and inadequately explained, and the proposed appeal lacked merit: the sentence of 10 years and 4 months was within the appropriate range given the 380g heroin and the international importation aggravating factor, a 15‑year starting point was justified and a one‑third discount for guilty plea was properly applied; the applicant's HIV did not justify further reduction and disparity with another judge's sentence did not merit interference.

The Court refused leave to appeal and held the sentencing judge was entitled to adopt a 14 years 6 months starting point, to add 6 months for importation and to apply the conventional one-third discount for the guilty plea; therefore the 10 year sentence was not wrong in principle nor manifestly excessive.

Given the quantity of heroin, the aggravating element of importation and existing authority, a starting point of 24 years was appropriate and the conventional one-third reduction for the guilty plea to 16 years was correctly applied; there is no merit in the application for leave to appeal and it is dismissed.

The Court dismissed the application for leave to appeal. It held the trial judge was entitled to adopt a 10 year starting point for unlawful trafficking (including a 6 month enhancement for importation), that the money‑laundering offence was a separate earlier matter with an appropriate starting point inferred from the earlier plea and sentence, and that in light of totality it was appropriate for the 6 years 8 months sentence to be wholly consecutive to the 12 month sentence.

The Court dismissed the application for leave to appeal, holding that the judge's starting point of 20 years was consistent with authority and that adding one year to reflect the international/importation element was justified; personal, family and health grounds did not warrant reduction for such a grave trafficking offence.
