The Court of Appeal held it did not have power to remit the matter to the District Court for a factual finding absent specific statutory authority; accordingly, in the absence of a finding on a disputed fact relevant to sentence the court will follow the principle in Costley and impose a sentence reflecting the version most favourable to the appellant, resulting here in reduction of the sentence.
