The single justice referred the discrete question of whether the appeal should be heard in open court or in camera to the full court pursuant to Order 59 Rule 14(10), holding that an application for a private hearing must be made by summons under PD 25.1 para 5 and must be specifically justified because of the constitutional importance of open justice (Article 10); consequently the appeal will be heard initially in open court and the full court will balance competing considerations and decide whether to sit in camera.
