The Court granted leave to appeal because there is a reasonable prospect that the issues of whether ss.55-57 EdO give rise to enforceable private rights or contractual obligations and whether the PS in fact withdrew approval or approved a successor before the office was vacated are arguable; the Judge's inference that the PS had withdrawn approval lacked sufficient evidential basis and the incorporation of the EdO into the contract raises triable issues about the IMC's obligation before termination.
