The court held the magistrate was wrong to treat payment under a police officer's s.3(1) notice prior to a Commissioner s.3(3) notice as falling outside the circumstances in which a person 'becomes liable to a fixed penalty' for purposes of the Points Ordinance; all statutory mechanisms that effect incurrence of a fixed penalty are to be treated consistently so that such payment does incur points under s.4(1)(b), and the magistrate's construction of s.2(2) was rejected.
