Where a defendant gives a statement to law enforcement about others' criminality and subsequently gives sworn evidence irreconcilable with that statement in material respects, and the defendant offers no satisfactory explanation for the conflict, the Crown may convict of attempting to pervert the course of public justice even if it cannot prove which account is false; however mere change of mind or refusal to give consistent evidence without an overt act is insufficient.
