Although the prosecution failed to reconsider joinder after the earlier severance and thus breached the Indictment Rules, the accused had acquiesced in earlier severances and themselves sought further severance; special circumstances therefore exist and the prosecution's conduct, while negligent, did not amount to mala fides or such an abuse of process as to justify a permanent stay. The application for a stay is dismissed.
