On the balance of probabilities the applicant's judgment was impaired by alcohol which caused his failure to react to a road defect while driving a heavy loaded lorry; the accident was directly attributable to the applicant being under the influence and constituted serious and wilful misconduct within the meaning of the Employees Compensation Ordinance, so the respondent is not liable to pay compensation.
