The stay was refused because the trial judge's factual findings are entitled to deference and are unlikely to be overturned on appeal, the alleged risk of dissipation was speculative and irrelevant where judgment is against the company rather than the individual shareholder, and company law remedies exist to protect minority shareholders; accordingly the injunction was uplifted and monies paid into court were ordered returned to Emagist (with certain payments provided by order nisi).
