On the balance of probabilities the court was not persuaded by convincing contemporaneous evidence or reliable witness recollection that any oral agreement was made which superseded the written break clauses; the Addendum did not effect a removal of the termination-at-will rights and therefore the Airlines were entitled to terminate as per the written agreements; rectification and injunctive relief were refused and damages would be an adequate remedy.
