The rear wall and the blocked-off portion were features of the original development and therefore constituted common parts at the date of the first assignment; accordingly the mandatory injunction ordering removal of the portion within CP25 was wrongly made and was set aside, but the applicants were entitled to an injunction against Tang restraining parking that obstructed access to CP27 and to damages of HK$54,000 for interference with their exclusive right to quiet enjoyment of CP27.
