The Order was a refusal to permit an amendment that would introduce a new issue (a true innuendo) and thus was a summary determination for which leave was not required; in any event the proposed innuendo pleadings failed as they lacked the mandatory particulars required by Order 82 r3 (identification of indirect recipients with special knowledge, particulars of re-publication and extrinsic facts), so amendment was properly refused and there was no reasonable prospect of success to justify leave under s14AA.
