The Tribunal accepted the two in‑building duplex comparables as the best evidence, rejected the respondent's minimal allowance for refurbishment and the applicant's larger uniform adjustments, applied intermediate adjustments for refurbishment, view and floor level producing adjusted unit rates of about HK$230/m2 and HK$250/m2, adopted an average unit rate of about HK$240/m2 and determined the PMR at HK$58,500 per month; the Tribunal refused the respondent's claim for aborted inspection costs under s119R because the applicant's conduct was not frivolous or vexatious.
