The appeal was dismissed because the judge validly found on the balance of probabilities that the crane lorry registered EY 3981 struck the plaintiff; that finding was justifiable by the contemporaneous information available to Mr Chan and his own familiarity with the vehicle, such that the double hearsay evidence was reliably admissible under s49.
