ORT had failed on Item 5 and had withdrawn or modified other claimed items after HF raised justified objections; those failures and belated concessions caused non-trifling unnecessary costs such that a 20% reduction of ORT's claimed costs was justified. The order nisi was varied so that HF pays ORT HKD 695000 and ORT bears the costs of the summons and pays HF HKD 35000 to be set off against the award.
