The Court of Appeal upheld the trial judge's factual findings and dismissed the appeal on the substantive liability: the loan agreement was valid, the defendant was liable for HK$943,000 and contractual interest at 30% p.a. was enforceable; however, because the effective claim fell within Regional Court limits and no complex issues justified retention by the High Court, the trial costs are to be assessed according to the Regional Court scale and by summary (simplified) procedure as ordered by the Court of Appeal.
