The court refused the interested party's application because it was made late, raised new constitutional grounds not covered by the applicant's leave, would cause real prejudice and disruption to the scheduled one‑day substantive hearing, lacked adequate explanation or urgency, and because the Director's decision did not, on the material before the court, deprive the interested party of the ability to leave Hong Kong by other lawful means; accordingly the court exercised its discretion to refuse and to lift the automatic stay so the substantive hearing could proceed as scheduled.
