The Mother failed to establish that Taiwan was clearly or distinctly the more appropriate forum. The Mother’s issue of a substantive Custody Summons in Hong Kong constituted conduct inconsistent with a challenge to jurisdiction and indicated submission to the Hong Kong forum; the Child’s limited social integration in Taiwan and the balance of trial-related factors did not favour Taiwan sufficiently; therefore the stay on forum non conveniens is dismissed and the Variation Summons is partially allowed with revised interim access orders.
