The court accepted the defendant's evidenced billing arrangement and mailing records, rejected the plaintiff's claim that nine interim bills were never issued or that a signature was required before deductions; the retainer was lawfully exhausted by fees detailed in the interim bills, so the plaintiff had no basis for a refund and the claim is dismissed.

The retainer did not authorize issuance of multiple periodical final bills; having regard to the retainer language promising interim bills with final reckoning, the bulk delivery of many bills, settlement by appropriation from costs on account prior to receipt, overlapping time periods and subsequent additions by later bills, the Further Bills were interim in nature and therefore susceptible to variation and taxation rather than binding final accounts.

The retainer expressly authorised monthly self-contained invoices which were delivered and accepted by the plaintiff; no special circumstances were proven to justify taxation of paid bills more than 12 months old or paid bills 4–7; bill 8 was settled by a concluded agreement; bills 9 and 10 (unpaid) are ordered taxed provided their full amounts are paid into court within one month; defendant entitled to costs on party and party basis.
