On the provisional affidavit material the court found there is a serious issue to be tried that the defendants' use of the NERIUM/Nerium‑style signs on Optimera products may infringe the plaintiffs' registered trade marks and that Hong Kong is an appropriate forum to determine those claims; accordingly interim interlocutory relief to restrain specified use in Hong Kong to abide the further hearing was justified, leave was granted to admit the late affidavit of Eric Haynes with limited weight and no security to fortify the plaintiffs' undertaking was ordered at this stage.
