Leave to appeal was refused because the defendant's grounds had no reasonable prospect of success: liability had been finally determined by earlier interlocutory judgment and prior refusals of leave; the defendant had effectively abandoned contesting liability at trial; the criticisms of the damages assessment were repetitive, unsupported and did not demonstrate a legal error or unfairness warranting an appeal; accordingly no basis to permit an appeal and the usual costs order was made.
